SUBJECT:
Requesting approval of a master service agreement with Huff & Huff, Inc. for environmental services related to the City of Aurora's Clean Construction and Demolition Debris program for 2015 in an amount not to exceed $75,000.00.
 
PURPOSE:
The City's Clean Construction and Demolition Debris (CCDD) program is an Illinois Environmental Protection Agency (IEPA) requirement to evaluate excavated material associated with water and sewer utility work.  This contract would assist City Engineering staff's evaluation of the potential for contamination in the excavated material and the proper lawful disposal of this material at appropriate locations.  Our preferred disposal site, Heartland, accepts CCDD materials from the City of Aurora for no charge, if the material meets environmental requirements dictated by the IEPA.  The Huff & Huff 2015 master service agreement (MSA) provides professional consulting services for this evaluation and paperwork.
 
BACKGROUND:
Huff & Huff has provided CCDD consultation on a project-by-project basis for 2013 and 214.  The 2015 MSA would streamline this process by issuing one purchase order for the year to cover all anticipated projects.  In 2013 Huff and Huff provided $52,773.27 in services, and $67,285.10 in services in 2014.  A budget of $75,000.00 seems reasonable based on past City needs.
 
DISCUSSION:
The Huff and Huff 2015 MSA benefits the City of Aurora's Long Term Control Plan by evaluating CCDD materials at various project locations anticipated next year.  The CCDD evaluation is critical to disposal of materials at Heartland, the City's preferred disposal site.  Heartland accepts City CCDD materials at zero cost as part of an agreement with Heartland and saves the City of Aurora significant construction costs.  However, Heartland requires evaluation of the materials, as required by the IEPA, to accept CCDD materials.  This MSA would draw from the following accounts:

IMPACT STATEMENT:
This 2015 MSA will have no impact to the general public or information technology.
 
RECOMMENDATIONS:
We request approval by the Buildings, Grounds & Infrastructure Committee and City Council to approve the aforementioned 2015 Master Service Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City of Aurora generates excavated material from various water and sewer utility projects that is regulated by the Illinois Environmental Protection Agency's Clean Construction and Demolition Debris (CCDD) program that requires proper disposal; and
 
WHEREAS, the City has frequently contracted professional CCDD evaluation services with Huff & Huff, Incorporated on a project-by-project basis for the past several years; and
 
WHEREAS, a copy of the proposed master service agreement has been included as Exhibit "A", with legal revisions proposed by the City of Aurora and accepted by Huff & Huff, Inc. as Exhibit "B"; and
 
WHEREAS, the 2015 City budget has funding for the project in the following accounts;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing and City Clerk be and are hereby authorized to enter into a 2015 Master Service Agreement for soil management and CCDD documentation for various on-call environmental services with Huff & Huff, Inc., 915 Harger Road, Suite 330, Oak Brook, IL 60523 in an amount not to exceed seventy five thousand dollars and zero cents ($75,000.00) as per the attached proposal herein Exhibit "A" and proposed legal revisions per Exhibit "B".
