SUBJECT:

Resolution Authorizing the City of Aurora to Enter into a Residential Lease Agreement for 22 West Park Place, Aurora, IL.

 

PURPOSE:

To obtain City Council approval to enter into a new lease agreement through December 31, 2018 should both parties mutually agree, for city-owned property located at 22 West Park Place.

 

BACKGROUND:

The subject property referred to as the Logman house was purchased in 2009 by the City of Aurora. It is across the street from McCarty Park. At the time of purchase, the thought was that this property would allow for future park amenities tied into McCarty Park which is just across the street. Unfortunately due to the unforeseen economic downturn, plans to develop this property for future Park or other use were put on hold indefinitely.  The house has been rented by a City of Aurora employee off and on since 2013.  The Logman house is the largest of the three Park Division rental homes.

 

DISCUSSION:

To preserve this asset the Logman house should continue to be occupied full time. Kelvin Beene, Property Standards Manager, is currently renting the property for $690.00 per month.  The new lease term is for one year and runs through December 31, 2018, after which time it becomes a month to month lease with annual increases of 3%.  In addition, there is a 60 day termination clause which provides the City the ability to review rental rates and duties on a periodic basis.  In exchange for the reduced rental rate as compared to current market rates for similar properties in Aurora Kelvin has and will continue to provide certain caretaker duties as outlined in the lease agreement and Exhibit A (attached).

 

IMPACT STATEMENT:

This agreement will generate revenue and provide cost savings on multiple fronts while preserving the City’s asset. Savings will be realized from no longer having to pay for gas and electric utilities. The tenant is also responsible for lawn maintenance. In addition, the tenant will open and close McCarty Park gates from October through March which will further reduce the City’s personnel expenses.

 

RECOMMENDATIONS:

In the interest of preserving this residential asset and to have a City managerial employee keep a watchful eye on both the Logman house and McCarty Park, I am recommending the City Council approve this residential lease agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora has previously leased the property located at 22 West Park Place to City of Aurora employees to preserve our residential asset and ensure oversight of the adjoining McCarty Park, and;

 

WHEREAS, Kelvin D. Beene, city employee, in exchange for below market rental rates, has agreed to assume caretaking duties typically not associated with leasing residential property as set forth in the attached lease agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the attached lease between the City of Aurora and Kelvin D Beene for 22 West Park Place, Aurora, IL in the same or substantially similar form.
