SUBJECT:

Resolution Authorizing the Mayor to sign the Economic Development Program Agreement with the State of Illinois and the Local Agency/Company Agreement with Amazon.com, Inc. and the Director of Procurement to sign the Engineering Services Agreement with HR Green, Inc. 

 

PURPOSE:

This Resolution will Authorize the EDP Funding Agreement and the Local Agency/Company Agreement for the Duke Parkway Extension Roadway Project and Approve the Engineering Services Agreement

 

BACKGROUND:

The Illinois Department of Transportation (IDOT) recently awarded the City of Aurora a funding opportunity through the Department's Economic Development Program (EDP).  The EDP will provide 50 percent of the funds to construct the extension of Duke Parkway and a new intersection at Illinois Route 59. These funds will provide safe adequate access to the Amazon Company, which plans to create 1,200 new positions.

 

DISCUSSION:

Plans and specifications for the roadway improvements noted above are being prepared for a proposed April local letting.  The construction and engineering, estimated to cost more than $4,700,000, will be funded by the awarded EDP funds and the remaining balance by the Project Developer, Duke Realty. 

 

The attached EDP Agreement (noted as Exhibit A) list the Division of Cost of $4,500,000 for Construction and $220,000 for Construction Engineering. IDOT requires this agreement to be approved by the City of Aurora and attach 3 stipulations identified as a Location Map, Employee Reporting Form (noted as Exhibit B) and the Local Agency/Company Agreement (noted as Exhibit C).

 

The Local Agency/Company Agreement includes provisions and employee reporting requirements that must be completed by Amazon.com, Inc.  This agreement needs to be signed by the Mayor and attached to the EDP Agreement.

 

The attached Engineering Agreement noted as Exhibit D in the amount of $216,525.24 from HR Green, Inc. will provide full time construction and material inspection for this project. 

 

Funds will be provided for this project through a Roadway Agreement with Duke Realty to Fund all construction and engineering that exceeds the EDP award.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora was awarded $2,000,000 from the Illinois Department of Transportation's Economic Development Program (EDP) to provide 50 percent of the funds to construct the extension of Duke Parkway and a new intersection at Illinois Route 59, and

 

WHEREAS, it is necessary and desirable to construct these improvements to provide access to the Amazon Company to create 1,200 new positions, and

 

WHEREAS, there is a need for the Economic Development Program Agreement for the award a copy of which agreement is attached hereto and incorporated herein as Exhibit 'A', and

 

WHEREAS, there is a need for a Local Agency/Company Agreement between the City of Aurora and Amazon.com, Inc., a copy of which agreement is attached hereto and incorporated herein as Exhibit 'C', and 

 

WHEREAS, there is a need for an Engineering Agreement with HR Green, Inc., 651 Prairie Point Dr., Suite 201, Yorkville, IL  in an amount not to exceed $216,525.24, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'D', and

 

 

 

WHEREAS, the funds for this project will be provided by a separate Roadway Agreement between the City of Aurora and Duke Realty to fully fund this project in excess of the awarded EDP funds.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor is authorized to sign the Economic Development Program Agreement with the State of Illinois (Exhibit 'A') and the Local Agency/Company Agreement with Amazon.com, Inc. (Exhibit 'C') and the Director of Procurement to sign the Engineering Services Agreement with HR Green, Inc. (Exhibit 'D').
