SUBJECT:

A Resolution Accepting the Dedication of a Watermain Easement West on the Aurora School District 129 Herget Middle School property located at 1550 Deerpath Road (West Aurora School District #129 - 15-00898 / SG12/3-15.229-DED/E - AM - Ward 5)  

 

PURPOSE:

The Petitioner, West Aurora School District, #129, is requesting to dedicate a city easement over a watermain to the City of Aurora on the Herget Middle School property at1550 Deerpath Road.  The easement is being requested to allow for a connection of the school's on-site dead-end watermain to the looped watermain within the Verona Ridge development.  

 

BACKGROUND:

The developer of Verona Ridge, Taylor Morrison of Illinois, Inc. previously Orleans Homes, is required to make this connection pursuant to their Annexation Agreement however the easement must be in place first.    

 

DISCUSSION:

Staff has reviewed the Plat of Easement submitted by the petitioner and have sent comments back to them on those submittals. The petitioner has made all the requested changes to this document and they now meet all of the applicable codes and ordinances. 

 

IMPACT STATEMENT:

The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by enhancing the city’s infrastructure and improving services to its residence.   

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the Resolution Accepting the Dedication of a Watermain Easement West on the Aurora School District 129 Herget Middle School property located at 1550 Deerpath Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it may be necessary in the future to construct and provide utilities in the easement area; and

 

WHEREAS, upon petition of the property owner, West Aurora School District #129, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities within an easement as described on Exhibit “A” Plat of Easement attached hereto; and

 

WHEREAS, the City desires to receive and accept the granting of such real estate, in accordance with Section 11-105-01 of the Illinois Municipal Code (65 ILCS (1994) 5/11-105-1); and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, that upon petition of the property owners, the City hereby receives and accepts the granting of the easement as described on Exhibit “A” Plat of Easement attached hereto; provided however, that such acceptance of granting does not relieve the developer of its obligations to construct such utilities in accordance with the City of Aurora Public Improvement Ordinance.
