PURPOSE:
To increase the number of Class E-Restaurant Liquor Licenses by one (1) license, increasing the total maximum number of Class E license to 47.  In addition, to make revisions to the number of various classifications to more accurately reflect the increases/decreases in said classifications based on records of the City and the Illinois State Liquor Control Commission.
 
BACKGROUND:
This request is presented in accordance with the 2011 amendment to the City's Liquor Ordinance, specifically Section 6-9(a) which charges the City Council with the authority to determine the number of licenses available in each classification.
 
DISCUSSION:
Colonial Ice Cream, Inc. d/b/a Colonial CafĂ© & Ice Cream, located at 1961 W. Galena Blvd., Aurora, Illinois, submitted a liquor license application seeking a Class E license for the purpose of being able to sell alcoholic liquor to its patrons for consumption on the aforementioned premises.  It is a well-established restaurant in the City of Aurora.
 
Attached is the application submitted for your consideration.  If approved, this resolution would increase the number of allowable liquor licenses as indicated in the accompanying Exhibit A to allow for the issuance of the license by the Commissioner.  City staff has been working with Colonial's representative to ensure that all requirements for a Class E license, as set forth in Section 6-8 of the City's Liquor Code, are met.
 
The revisions to Classifications A (Tavern), C (Package Liquor) and E (Restaurant) are intended to reflect the decreases which have occurred for various reasons, such as organization going out of business, voluntary relinquishment of license, bankruptcy filing.  The revised numbers coincide with the number of active licenses set forth in the City's records as well as the records maintained by the State Liquor Control Commission.  The specific revisions will be as follows: (i) Class A will decrease from 14 to 12; (ii) Class C will decrease from 44 to 41; and (iii) Class E will decrease from 52 to 46 (this number does not take into account the increase proposed herein).
 
 
 
IMPACT STATEMENT:
The proposed resolution will have no negative impact and will ensure accurate tracking of the maximum number of liquor licenses in each classification.
 
 
RECOMMENDATIONS:
I am recommending that this resolution be referred to the Government Operations Committee for consideration at its next meeting to be held on Sept. 24, 2013.
